INSTALLING AND USING THE SOFTWARE ACCOMPANYING THIS SOFTWARE LICENSE AGREEMENT (LA) INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. READ ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT PRIOR TO INSTALLING OR USING THE SOFTWARE. IF YOU DO NOT ACCEPT THESE TERMS, YOU MUST DELETE THE SOFTWARE FROM YOUR HARDWARE. PLEASE NOTE THAT YOU MAY NOT USE, COPY, MODIFY, OR TRANSFER THE SOFTWARE OR DOCUMENTATION OR ANY COPY, EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT.
MediaMover (SOFTWARE) is the intellectual property of Random Video, Inc. (AUTHOR) and is protected by international and the respective national copyright laws in licensee’s country.
No title to the intellectual property in the SOFTWARE is transferred to you (LICENSEE). The LICENSEE does not acquire any rights to the SOFTWARE except as expressly set forth in this license.

The SOFTWARE is licensed, not sold. LICENSEE (either an individual or a single entity) acquire some specific rights in respect of the SOFTWARE granted to LICENSEE by the applicable non-exclusive LA provided below. By installing, copying, running or otherwise using the SOFTWARE or any portion of it, LICENSEE accepts to be bound by all of the terms and conditions established by the LA.
AUTHOR reserves all other rights not expressly granted to LICENSEE by the LA. Any other use (i.e. unauthorized) of the SOFTWARE or any portion of it is in violation of the LA and will imply its automatic and immediate termination.
Subject to the License Agreement
There are two versions of the SOFTWARE: evaluation (UNREGISTERED SOFTWARE) and registered (REGISTERED SOFTWARE). The LA provides terms applicable solely to one of these versions, as well as common terms applicable to the same extent to both versions.
For the UNREGISTERED SOFTWARE, an evaluation license is FREE. Please visit our website at www.randomvideo.com to see how to REGISTER your copy of the UNREGISTERED SOFTWARE. Upon confirmation of your payment, you will be sent an activation code to convert your copy of the UNREGISTERED SOFTWARE to REGISTERED SOFTWARE.
Terms Applicable to UNREGISTERED SOFTWARE
A single license grants LICENSEE the following rights:
LICENSEE may make as many copies of the UNREGISTERED SOFTWARE as you wish and freely redistribute to third parties such copies by any means, provided that LICENSEE redistributes the UNREGISTERED SOFTWARE as a whole, in its original, unmodified form and LICENSEE does not charge or request donations for the UNREGISTERED SOFTWARE.
LICENSEE may install and run the UNREGISTERED SOFTWARE on any number of computers (workstations), provided that you install and run the UNREGISTERED SOFTWARE for EVALUATION purposes only.
The UNREGISTERED SOFTWARE license is not time-limited. Some functions in the UNREGISTERED SOFTWARE have been disabled and are enabled only upon converting to REGISTERED SOFTWARE. LICENSEE may EVALUATE the UNREGISTERED SOFTWARE for as long as needed.
Terms Applicable to REGISTERED SOFTWARE
A single license grants LICENSEE the following rights:
LICENSEE will not make copies of the REGISTERED SOFTWARE or allow copies of the REGISTERED SOFTWARE to be made by others, unless authorized by this License Agreement. LICENSEE may make copies of the REGISTERED SOFTWARE for backup purposes only.
LICENSEE may install the REGISTERED SOFTWARE on a single computer. LICENSEE is permitted to run the REGISTERED SOFTWARE in a distributed computing environment, such as local area network, where users of various workstations connected to the network can access interactively the REGISTERED SOFTWARE one user at a time. If you require that multiple employees of your organization be able to use the REGISTERED SOFTWARE simultaneously, you should purchase as many licenses as needed. Note that quantity discounts are available (contact AUTHOR).
Description of other Limitations
LICENSEE is specifically prohibited from redistributing copies of the REGISTERED SOFTWARE or any portion of it (except as provided by the LA) or any other information accompanying your REGISTERED SOFTWARE license, such as a software activation code, if any, to third parties for any purpose. Intentional violation of this term will imply immediate and automatic termination of your LA. In case such redistribution took place without LICENSEE’S direct participation (e.g. the SOFTWARE was stolen), LICENSEE should immediately notify AUTHOR about the incident.
Reverse Engineering or Cracking
LICENSEE may not reverse engineer, decompile, disassemble or modify executable files, dynamic link libraries or any other binary files, which make up the SOFTWARE. This includes any copyright notices as well as object code and resources incorporated in the files and implies using run-time debuggers, development tools or other similar means.
For the REGISTERED SOFTWARE, upgrades are FREE within the same major version number.
When LICENSEE acquires a REGISTERED SOFTWARE license, LICENSEE agrees to be subscribed to the registered users mailing list. The sole purpose of this mailing list is to announce and distribute future SOFTWARE releases and addons. AUTHOR will never give LICENSEE’S email address to third parties unless the applicable law requires it.
Disclaimer of Warranty and Liability for Damage
ALTHOUGH AUTHOR HAVE MADE EVERY EFFORT TO ENSURE THE ROBUST AND STABLE FUNCTIONALITY OF THE SOFTWARE AND ITS CONFORMITY TO THE ACCOMPANYING DOCUMENTATION, THE SOFTWARE AND ANY RELATED MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. LICENSEE USES THE SOFTWARE ENTIRELY AT LICENSEE’S OWN RISK. IN NO EVENT SHALL AUTHORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGE, DATA LOSS, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS ARISING OUT OF USE (OR MISUSE) OF THE SOFTWARE.
The SOFTWARE is not meant to be fault-tolerant and is not designed, manufactured, or intended for use in such applications as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of SOFTWARE could lead directly to death, personal injury, or severe physical or environmental damage (High-Risk Activities). AUTHOR specifically disclaim any express or implied warranty of fitness for High-Risk Activities.
The headings in the LA are provided for the sake of convenience only. They have no other meaning.
